Why Are TBIs Legally Challenging?

Traumatic Brain Injury (TBI) is an injury to the brain causing a loss of consciousness lasting for less than 30 minutes, or alternatively, a period of confusion or disorientation which lasts for less than 30 minutes.

TBI’s or Post-concussive Syndrome (a mild TBI or MTBI) can occur from many types of impacts, including motorcycle, car, and truck accidents and/or fall injuries.

Symptoms can include:

Headaches, confusion, lightheadedness, dizziness, blurred vision, ringing in the ears (tinnitus), sleepiness, nausea, sensitivity to light and sound, “fuzzy” thinking, depression, sleep disturbances, visual disturbances, and even seizures.

Around 15% of people who suffer an MBTI experience post-concussive symptoms for more than a year after the initial injury was sustained.

Proving the damages caused by a brain injury can be difficult. In many cases, people with brain injuries may appear to be just fine to the outside, but they suffer from mild to severe symptoms that affect their activities of daily living, causing them to be unable to work or earn a living or, in some cases, even care for themselves. This damage does not appear on brain imaging tests like CT scans and MRIs.​
